Terms of Service

1. General

These general terms and conditions (GTC) apply to all goods orders from private customers via the online shop of Macos Coffee Crafters GmbH or in other ways (telephone, e-mail, SMS, etc.) and are binding. Different terms and conditions are only valid if they have been expressly accepted in writing by Macos Coffee Crafters GmbH and the buyer. All agreements and legally relevant declarations of the contracting parties must be in writing to be valid. The General Terms and Conditions apply to every order in the version at the time the contract was concluded.

The General Terms and Conditions are subject to change at any time. In addition, the relevant provisions of the Swiss Code of Obligations shall apply, provided no regulations are contained in the General Terms and Conditions. Place of jurisdiction is Zug.

2. Conclusion of contract

All information on goods and prices on the company's website is subject to change and non-binding. By ordering via the homepage, the customer submits a binding offer. The purchase contract is concluded for an order in the online shop with a confirmation email after receipt of the order. For other types of order, Macos Coffee Crafters GmbH will confirm in the same way as the order. If the ordered goods are no longer available, the customer will be informed by e-mail. There is no contract for the non-deliverable products.

The ordered products will only be shipped after receipt of payment.  Macos Coffee Crafters GmbH can withdraw from the contract if the customer has not paid within 10 days of sending the order confirmation.

3. Territory

Delivery is only within Switzerland and the Principality of Liechtenstein. Orders from other countries can only be considered in personal consultation.

4. Prices and shipping costs for private customers

The prices given are in Swiss francs (CHF), including the statutory value-added tax. Shipping costs for postage and packaging will be added. The exact shipping costs are displayed in the ordering process. From an order value of CHF 100, there are no postage and packaging costs. Shipping is by B Mail/PostPac Economy.

5. Payment

5.1 General

Only the payment methods available in the checkout process are available for selection.

5.2 Coffee machines, grinders and accessories

Coffee machines, grinders and accessories are in stock to our suplier.

Coffee machines, grinders and accessories with a gross value of more than CHF 300.00 will only be handed over against prepayment or cash/credit card payment upon collection.

5.3 Default in Payment and Passing of Risk

Macos Coffee Crafters GmbH reserves the right to withdraw from the contract and to demand the return of the products if the customer is in arrears with a service owed under the agreement.

All risks of loss of or damage to the Products shall pass to the Customer upon acceptance (or by persons acting on behalf of the Customer) of delivery. 

5.4 Dunning

After the 14-day period has expired, the customer is in default without any further reminder. After the payment period has expired, a first payment reminder will be sent by e-mail. Thereafter, a fee-based reminder is sent by post. The costs for reminders (CHF 30.00), interest on arrears (5%) and collection measures will be charged to the customer. 

6. Delivery
6.1 Delivery Period

 The delivery period begins with the acceptance of the order by Macos Coffee Crafters GmbH and depends on the availability of the ordered goods. 

The approximate current delivery times and availability of the products can be seen on the order page. This information is without guarantee. In the event that an order arrives late at the customer, claims for damages are excluded. 

The delivery costs are 9 CHF. The goods are usually delivered within 3 working days, subject to availability. Coffee machines, grinders and accessories will be delivered within 7working days upon availabilty from our suplier.  Use and risk lie with the customer from the time the goods are handed over to the carrier.

When paying in advance, the delivery may be delayed, depending on the receipt of payment.

The delivery period is extended appropriately:

- if the information required for the execution of the order is subsequently changed.

- if obstacles arise that Macos Coffee Crafeters GmbH cannot avert despite exercising the required care, regardless of whether these arise at Macos Coffee Crafters GmbH, the customer or a third party. Such impediments are, in particular, events of force majeure, such as epidemics, mobilization, war, riots, significant disruptions to operations, accidents, labor disputes, late or incorrect delivery of the required raw materials, semi-finished and finished products, important workpieces being rejected, official measures or omissions, natural phenomena.

6.2 Inspection and Acceptance of the Delivery 

At the time of delivery, the customer is asked to check that the number of items delivered corresponds to the number indicated on the delivery confirmation/invoice and that the products are intact, undamaged, not wet and unaltered in any way.

If the customer finds any damage or missing items, he must notify Macos Coffee Crafters GmbH in writing within five (5) days of delivery. If possible, Macos Coffee Crafters GmbH will provide identical replacement products in this case.

If the customer fails to do this, the deliveries are deemed to have been approved.

Unapproved, damaged or defective products remain the property of Macos Coffee Crafters GmbH and must be sent back/returned immediately. Replacement or refund claims can only be considered after the damaged or defective products have been assessed by Macos Coffee Crafters GmbH.

7. Right of Withdrawal

We do not accept returns of coffee beans as this is a fresh, perishable product, and we package all of our coffee fresh. If the bag of coffee is an error on our part, we’ll replace it for the correct order.

The customer has the right to return the goods (except coffee beans) within 5 days of receipt. The right of withdrawal can only be exercised with legal effect if the goods are returned unused, undamaged, complete and in the unopened original packaging. Upon receipt of the returned goods in the condition described, the company will reimburse the customer for the value of the goods.

Shipping costs that have already been incurred cannot be reimbursed. For reasons of hygiene, we neither take back wrongly ordered goods nor exchange them.

8. Privacy

All personal data will be treated confidentially. Data required for business transactions are stored and, if necessary, forwarded to affiliated companies as part of order processing. Address data can also be used for advertising purposes, whereby the customer can object to this use of the data at any time. In addition, Macos Coffee Crafters GmbH maintains a data exchange for creditworthiness information for the purpose of credit checks.

On this website, data is collected and stored anonymously for marketing and optimization purposes using web controlling technologies.
